TERMS AND CONDITIONS

Tribu News provides a service for creating, printing and automatically sending a product that brings together your photos and messages and can be edited by customers (including deleting, moving and adding content). The services provided by Tribu News include creating the product, printing it, automatically sending one or more printed copies by post, and sending the digital version by email.

You accept these Terms and Conditions without reservation by doing any of the following: (A) selecting “I agree” to these Terms; (B) completing the registration process; (C) using the Website in any way; or (D) logging in to the website “www.mytribunews.com”. By doing so, you enter into a legally binding agreement with Tribu News.

Before using our services, we strongly recommend that you carefully read these Terms and all related documents, including our Privacy Policy.

In these Terms, all references to “you”, “your” and/or “User” refer to the party using the Services or the Website and thereby entering into an agreement with Tribu News subject to these Terms.

1. Eligibility.

By using the Services, you represent and warrant that: (A) all registration information you submit is truthful and accurate; (B) you will keep this information accurate and up to date and are fully capable and competent to enter into a binding agreement with Tribu News; (C) you are authorised to accept these Terms on behalf of yourself and/or the entity you represent; and (D) your use of the Services does not violate any applicable law or regulation.

Tribu News reserves the right to delete your account if we believe that any of the above statements are untrue.

2. Registration.

2.1. To use the Services, you must create and register an account (your “Account”). The following information is required: First name, Last name and Email address. Once your Account has been successfully created, you will be considered a “Member”. If you log in via Facebook Connect, your Account will be linked to the email address provided through your Facebook account.

2.2. You are responsible for all activities that take place under your Account.

2.3. You agree to notify us immediately of any unauthorised use of your Account or any other security breach relating to your Account or the Website.

3. Subscriptions

3.1. As a Member, you may purchase a subscription to a journal or other product made available by Tribu News.

3.2. When purchasing a subscription, you represent that:

i. you have all necessary rights to order such a product;

ii. the products are intended for personal use only;

iii. you may not resell the products.

3.3. Each product will be created based on the options you select (Facebook and/or Instagram) and the content you provide. Tribu News reserves the right, at any time and without prior notice, to provide a product with fewer pages than initially planned if the amount of available content is insufficient to create a complete product.

3.4. The price and delivery charges applicable to each subscription are those displayed on the Website at the time of ordering. You may also be responsible for additional charges not billed by Tribu News, such as customs duties, import fees, bank charges and similar costs.

3.5. Your Tribu News subscription may, if you choose this option, renew automatically until cancelled. Unless you cancel your subscription before the shipping date of the first product of the new subscription period, you authorise us to charge the fees for the following subscription period using your chosen payment method.

3.6. Cancellation. You may cancel your Tribu News subscription at any time and will continue to have access to the Service until the end of the subscription period that has already been billed. We do not provide refunds or credits for partially used subscription periods. To cancel your subscription, email [email protected]. If you cancel your subscription, your Account will automatically be closed at the end of your current billing period. To find out when your Account will be closed, click on “Billing details” under “Your account”.



3.7. Referral Program.

3.7.1. Tribu News may offer a Referral Program allowing a Member (the “Referrer”) to recommend Tribu News to a new customer (the “Referred Customer”) and, subject to certain conditions, receive a benefit such as credits, a discount or another reward for the Referrer and/or the Referred Customer (the “Referral Offer”).

3.7.2. The Referral Program is intended solely for private and personal recommendations (for example, direct messages, emails or individual sharing). Publishing, distributing or promoting referral offers on coupon or discount websites, deal platforms, public groups, promotional forums or any equivalent public channel is prohibited. Self-referrals through multiple accounts or any other method intended to circumvent the purpose of the program are also prohibited. In the event of non-compliance, Tribu News reserves the right to cancel the Referrer’s benefit and may also cancel the Referral Offer, without compensation.

3.7.3. The Referred Customer must be a new customer who has never previously had an Account or an active subscription with Tribu News. Tribu News reserves the right, at its sole discretion, to (i) refuse, suspend, cancel or recover any referral benefit in the event of suspected fraud, abuse, improper use or circumvention, and/or (ii) modify, suspend or terminate the Referral Program at any time. Benefits that have already been used are not refundable.

3.7.4. The practical terms of the program (eligibility requirements, value of benefits, validity period, etc.) are described for information purposes in the FAQ: https://faq.mytribunews.com/fr/article/le-parrainage-comment-ca-fonctionne-1b1brin/. In the event of any conflict between the FAQ and these Terms, these Terms shall prevail.

4. Content.

4.1. Definitions. “Content” includes text, files, design templates, images, photos, videos, sounds, copyrighted works and other materials. Your product includes Content that you add and submit to Tribu News for printing.

4.2. Ownership of your Content. Tribu News does not claim ownership of your Content. You remain the sole owner of your Content. You represent and warrant that: (i) you own the Content or otherwise have the right to grant the licences set out in this section in relation to the Content you provide for our printing services; and (ii) the Content of your product does not infringe any privacy rights, publicity rights, copyright or other rights of any person or entity.

4.3. Licence to print your products. You grant Tribu News a non-exclusive, worldwide, fully paid-up and royalty-free licence to reproduce and distribute your Content solely for the purpose of printing and delivering your products. You agree that Tribu News may retain electronic files relating to books or other products in order to maintain an archival copy of the printed book or product.

4.4. Your Content. You are solely responsible for all Content displayed by or through your Account on the Services, including any Content you have received from third parties. You agree that Tribu News may set limits on the storage and archiving of products, including, without limitation, the right to delete such data after a certain period.

4.5. Prohibited Content. You agree not to publish, submit for printing, or otherwise make available through the Services any prohibited Content. “Prohibited Content” includes any Content that: (i) is offensive or pornographic, or promotes racism, sectarianism, hatred or physical violence of any kind against any group or individual; (ii) bullies, harasses or advocates bullying, intimidation or harassment of another person; (iii) is false or misleading, or promotes, endorses or encourages illegal, abusive, threatening, obscene, defamatory or libellous activities or conduct; (iv) promotes, reproduces, performs or distributes an illegal or unauthorised copy of another person’s copyrighted work or trade secret, including providing pirated software or links to it, providing information intended to circumvent copy protection measures, or providing pirated music or links to pirated music files; (v) involves the sexual or violent exploitation of persons or solicits personal information from anyone under the age of majority; (vi) provides instructions relating to illegal activities such as manufacturing or purchasing illegal weapons, violating another person’s privacy, or creating or distributing computer viruses or other harmful code; (vii) solicits passwords or personally identifiable information from other users for commercial or unlawful purposes; (viii) violates any applicable law, including, without limitation, laws and regulations governing export controls, unfair competition, anti-discrimination and false advertising; (ix) involves commercial activities that are harmful to the interests of Tribu News; or (x) violates these Terms or creates liability for Tribu News. You agree to indemnify and hold harmless Tribu News and its subsidiaries, affiliates, officers, employees, suppliers, service providers and business partners from and against all claims, losses, liabilities and expenses arising out of or relating to any breach of this section.

5. Acceptance Policy.

5.1. Your subscription will be considered accepted once you receive an order confirmation at the email address associated with your Account.

5.2. Once an order confirmation has been received, your subscription may no longer be terminated or cancelled by you unless the order is covered by a specific scheme such as our “satisfaction guarantee”.

5.3. Notwithstanding the order confirmation, Tribu News reserves the right, at any time after receiving your order, to accept or reject it for any reason.

5.4. We may require additional verification or information before accepting any order.

6. Conditions of Sale.

6.1. Eligibility; Payment Terms. To purchase a subscription, you must be at least eighteen (18) years old or have reached the applicable age of majority in your jurisdiction. You may pay for your order using the following payment methods: Visa, Mastercard, Bancontact and SEPA.

7. Delivery.

7.1. Each subscription must have at least one delivery address.

7.2. All deliveries and print orders are processed as quickly as possible, but the process may take between 3 and 7 business days.

7.3. Delivery times. The first edition will be delivered at the beginning of the month following the start of the subscription. Subsequent editions will be sent at the beginning of each month following the creation of the journal. The delivery time includes the time required to prepare your order for dispatch and the time required for delivery by the carrier. Delivery times may be extended due to circumstances beyond our control.

8. Return and Refund Policy.

All our products (Baby Book, Year Album, Family Journal) are personalised products made to order using the photos and text provided by the customer. In accordance with Article 16(c) of European Directive 2011/83/EU on consumer rights, the statutory 14-day right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.

This exception to the right of withdrawal does not affect any rights the consumer may have under the applicable statutory guarantee of conformity.

In addition to this statutory guarantee, Tribu offers a 30-day commercial guarantee from the date you receive your order. If your product has a manufacturing defect or has been damaged during transport, you may choose between a full refund or a free replacement of the product. Any return shipping costs will be fully covered by Tribu.

To make a claim, contact our customer service team at [[email protected]](mailto:[email protected]) within 30 days of receiving your order. If possible, please include a photo of the defect to help us process your request more efficiently.

9. User Conduct

9.1. You agree not to access or attempt to access the Website by any means other than the interface provided by Tribu News, or to circumvent any access or usage restrictions put in place by Tribu News to prevent certain uses of the Website.

9.2. You agree to use the Website and the Services in good faith and in accordance with these Terms and not to use, encourage others to use or allow others to use the Website to:

i. impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity;

ii. access or use the Website in a way that could damage, disable, overload or compromise any server or network connected to a Tribu News server;

iii. intentionally or unintentionally interfere with or disrupt the Website, violate any laws relating to access to or use of the Website, violate the requirements, procedures, policies or regulations of networks connected to the Website, or engage in any activity prohibited by these Terms;

iv. disrupt or interfere with the security of, or cause damage to, websites, accounts, passwords, servers or networks connected to or accessible through the Website or any affiliated or linked sites;

v. disrupt or prevent any other user from using and enjoying the Website or any other affiliated websites or linked platforms;

vi. reproduce, sell, trade, resell or commercially exploit any part of the Website, its use or access to it;

vii. commit fraud, defame any person or otherwise violate legal rights, including privacy and publicity rights;

viii. use automated methods or tools to extract data from any part of the Website without our prior express written permission. We may use robot exclusion headers on the Website, and you agree to comply with them;

ix. decipher, disassemble or otherwise attempt to derive any source code, underlying ideas or algorithms of any part of the Website, except to the limited extent that applicable laws expressly prohibit such restrictions;

9.3. In addition, as a condition of using the Services and/or the Website, you agree to comply with all applicable laws, regulations and ordinances.

9.4. In order to enable us to protect the quality of our products and Services, you agree that our employees and representatives may access your Account and files where necessary and at our sole discretion. We also reserve the right, but do not assume any obligation, to monitor or review your conduct while using the Services and the Website. Your use of the Services and the Website is subject to all applicable local, national and international laws and regulations. You also acknowledge that you are responsible for obtaining or providing all internet, telephone and computer connections and equipment, including any modem or other devices required to access the Website, and for paying all related charges.

9.5. You agree not to use the Services for any unlawful activity. Tribu News reserves the right to investigate any suspicious activity or any reported complaint. When investigating such activity, Tribu News reserves the right to report suspected unlawful activity to any appropriate person or authority and to provide them with all relevant information, including personal data.

9.6. If you identify an error in any transfer sent or received as a result of using the Services, you must notify us immediately at [[email protected]](mailto:[email protected]). If you discover that you have received an amount greater than expected, you must notify us immediately so that arrangements can be made for the prompt return of any overpayment.

10. Tribu News has the right, but not the obligation, to review any Content and to remove any Content that, in Tribu News’ sole judgement, violates these Terms (4.5. Prohibited Content).

11. Copyright Policy.

11.1. Tribu News respects the intellectual property rights of others and expects its Members to do the same. It is Tribu News’ policy to terminate the membership of any Member who infringes copyright following appropriate notification to Tribu News by the copyright holder or the copyright holder’s legal representative.

11.2. If you believe that your work has been copied and published through the Services or used in a way that constitutes copyright infringement, please provide us with the following information: (i) an electronic or physical signature of the person authorised to act on behalf of the copyright owner; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located within the Service; (iv) your address, telephone number and email address; (v) a written statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, their agent or the law; and (vi) a statement by you that the information provided in your notice is accurate and that you are the copyright owner or authorised to act on behalf of the copyright owner.

12. Copyright / Trademark Information. The Website and the Content contained on it, including the Website design, plans, drawings, illustrations, photographs, images, text, graphics and other materials (the “Information”), are protected by Belgian copyright law, international treaties and copyright laws in other countries. The Information is owned by Tribu News or by third parties who have authorised Tribu News to publish copyrighted Information on the Website. Users may not modify, copy, publish, distribute, broadcast, display, reproduce, license, create derivative works from or sell any part of the Information contained on the Website without Tribu News’ prior express written consent. Users acknowledge the existing copyright in the Information and agree not to make any commercial use of the Information or to alter or modify the Information or any part of it.

13. Third-Party Services.

13.1. You acknowledge and agree that Tribu News may engage third-party partners and suppliers in order to provide the Services to you.

13.2. By using our Services, you agree to be bound by any applicable terms of use established by the third-party partners and suppliers engaged by Tribu News. These terms apply in addition to the terms and conditions set out in these Terms.

13.3. By accepting these Terms and Conditions, you expressly acknowledge that Tribu News may act as an intermediary for the third-party partner and that Tribu News is not responsible for the acts or omissions of that partner.

14. Limitation of Liability. To the fullest extent permitted by applicable law, Tribu News shall not be liable to you or any third party for any indirect, incidental or special damages, including any loss or damage arising from your use of the Services.

15. Indemnification. You agree to defend, indemnify and hold harmless Tribu News, its subsidiaries, affiliates, officers, agents, partners and employees from and against any loss, liability, claim or demand, including reasonable legal fees, made by any third party arising out of or in connection with your use of the Services in breach of these Terms and/or your breach of any provision of these Terms.

Confidentiality and respect for privacy are among our major concerns.

We are committed to protecting your privacy and personal data. Privacy is at the core of our activities and our mission. To protect you and your family, all content we receive while you are using Tribu News and your personal information are subject to this privacy policy.

This privacy policy explains our policy on the type of information we may collect from you when you use the Tribu News site, why we collect it and how we use it.

We process your personal data in accordance with the legislation applicable to the protection of personal data, which includes the General Data Protection Regulation (GDPR - Regulation (EU) 2016/679) and the Belgian data protection laws, including that of 30 July 2018 on the protection of individuals with regard to the processing of personal data.

4. For what purposes do we process your personal data?

"Personal data" means any information relating to a directly or indirectly identified or identifiable person (data subject) and (i) that you provide to us yourself or (ii) that we attribute to you to enable you to use our services, or (iii) that are generated by your use of our services or by your activity on our site.

We process the following data:

We use the aforementioned data to:

1. contact you when you have left your contact details to obtain additional information on the services of TRIBU NEWS;

2. conclude and perform a contract that you have subscribed to or wish to subscribe to in order to use the services of TRIBU NEWS;

Your contact details also allow us to send you information on the activities of TRIBU NEWS and/or our products. TRIBU NEWS has a legitimate interest in promoting its services to people who have come into contact with it, who have expressed an interest in its activities or with its leads. TRIBU NEWS sends advertisements or newsletters by email only with the prior consent of the data subject (opt-in).

4.2. If you are a customer

We process:
• your personal identity data (surname, first name, date of birth);
• your personal information on your Facebook and Instagram account (optional);
• your contact details (email, telephone);
• your billing data (postal address, country, telephone, payment method);
• your data relating to the delivery of our products to the home address of your choice;
• your data relating to your IP address and your login on the TRIBU NEWS Platform;

We use the aforementioned data to:
1. conclude and perform a contract that you have subscribed to or wish to subscribe to in order to use our services;
2. send you targeted advertisements in order to promote our services (soft opt-in);

4.3. If you are a supplier or a commercial service provider, 



We process the following data:
• your personal identity data (surname, first name, gender, preferred language);
• your contact details (email, telephone);
• your professional information (company, position);

We process your data to be able to perform a commercial contract concluded with us.

4.4. If you are a visitor to our website 


When you visit our website, we collect information about your browser, IP address, etc., mainly to make the use of our site as efficient and user-friendly as possible and to protect our IT systems from attack and other unlawful activities. This data are collected by means of cookies (see the cookie policy).

The data are also used by the analysis tools that we use for online marketing purposes.

5. How long are your data kept?


We keep your data for as long as necessary for the conclusion of the contract, the performance of the contract or the follow-up of our contractual relationship.

We delete your personal data as soon as the purpose for which we collected and processed them ceases to exist, within the following deadlines:

1. The data processed in the context of the performance of a (future) contract are actively kept for as long as necessary for the performance of the contract or the follow-up of our contractual relationship, and will then be archived for the statutory period of 10 years for contractual actions, and then finally deleted at the end of the statutory period.

2. Data on leads processed as part of pre-contractual measures which do not lead to the conclusion of a contract are kept and will be deleted after 2 years if the lead has taken no commercial action within that period. 


3. Information collected during your visit to our website will be deleted in accordance with the cookie policy.


6. Who can your data be transferred to?


Your personal data may be transferred to our suppliers, subcontractors and professional service providers, who provide services including data processing on our behalf. These parties may process your personal data solely to perform their task and within the limits of our instructions.

Where our suppliers and subcontractors are located in countries outside the European Economic Area, TRIBU NEWS ensures that appropriate precautions and security measures are put in place to guarantee the security and confidentiality of your personal data. TRIBU NEWS will take particular care to observe the following safeguards:

• the country to which the personal data are transferred has been deemed adequate by a decision of the European Commission under Article 45 of the GDPR and the transfer falls within the scope of that adequacy decision;

• has concluded a contract with the recipient of the personal data containing the standard contractual clauses for the protection of personal data adopted by the European Commission pursuant to Article 47 of the GDPR;

We may transfer your personal data to public authorities or other third parties where required by law or where necessary to protect and defend our interests in court.

Apart from these cases, TRIBU NEWS does not communicate any of your personal data, whether pseudonymised or not, to third parties.

7. What security measures are implemented by TRIBU NEWS?


In order to protect your personal data against loss, destruction, and unauthorised access to or manipulation of your data, TRIBU NEWS has taken both technical and organisational security measures.

This means, firstly, that our IT system is equipped with backup, filtering and firewall systems to protect your personal data from any misuse, unauthorised disclosure, unlawful destruction or accidental loss and, secondly, that our employees have been made aware of the risks associated with data breaches and trained to properly process your personal data, and that access to your personal data is granted solely to persons authorised to do so for the performance of their duties. All our employees and partners who have access to and are involved in the processing of your personal information are bound to treat that personal information as confidential.

8. What are your rights regarding the processing of your personal data?


The GDPR gives you the following rights, which you can exercise by sending an email to our DPO at: [email protected].

Right of access: where permitted by law, you have the right to ask whether we are processing your personal data and what personal data about you are being processed. As a customer, the member area of the TRIBU NEWS Platform gives you access to most of the personal data that is processed by our services.

In any event, if you make a specific request, access will be granted only if, on the basis of the information in its possession, TRIBU NEWS can identify you with certainty. Any request for access to your data must be accompanied by a copy of your identity card.

TRIBU NEWS has 30 days to respond to your request; this period begins to run only when we have received all the information required to comply with your request.

Right of rectification: you can ask us to rectify and/or complete any of you personal data that is inaccurate or incomplete.

As a customer, the member area of the TRIBU NEWS Platform already allows you to correct and/or complete some of your personal data. Via “your account” you can: (1) confirm the accuracy of the personal information we have collected about you; (2) update your personal information.

Right to erasure: without prejudice to the statutory retention periods laid down in Article 5, you can ask us to erase your personal data, in particular when they are no longer needed for the purposes for which they were collected or processed, or if you have withdrawn your consent to their processing and there are no other lawful grounds for processing them.

Right to restriction of processing: subject to certain conditions, you have the right to request restriction of processing, in which case your personal data may not be processed, except for their storage, by TRIBU NEWS without your consent or for the establishment, exercise or defence of legal claims, for the protection of the rights of third parties or for reasons of important public interest.

Right to data portability: if technically possible, you have the right to ask us to transmit your personal data to another controller.

Right to object: you always have the right to object, without no need to state grounds and at no charge, to the use of your personal data for direct marketing purposes. In particular, you can unsubscribe from newsletters sent to you at any time using the link provided for the purpose in each email or in each advertisement or by sending us a request to that effect at: [email protected]

Right to withdraw your consent: if the processing of your personal data is based solely on your consent, you have the right to withdraw it at any time, although the withdrawal of your consent will not affect the lawfulness of processing carried out prior to withdrawal, or processing on legitimate grounds other than consent.

Right to lodge a complaint with the supervisory authority: If you consider that your rights in relation to the processing to which you are subject have been infringed by TRIBU NEWS, you can lodge a complaint at this address: [email protected], or if not satisfactorily addressed, to the relevant Data Protection Authority.

TRIBU NEWS is not responsible for the privacy policies or practices of other websites, even if you have accessed a third party website using links on our website.
